Boeing 737 MAX Documents FOIA Oral Argument on Thursday, April 20

Issues: Should the FAA be allowed, under Exemption 4 of the Freedom of Information Act (FOIA), to keep secret all documents submitted by Boeing to unground the 737 MAX, plus all documents used by the FAA to make its ungrounding decision? This court ruling will apply to all other federal agencies that rely on Exemption 4 of FOIA.

Can agency decisions be based on secret law and data known only to the agency and regulated parties?
