FlyersRights filed a rulemaking petition on October 5, 2022, the fourth anniversary of the Congressional mandate and the third anniversary of the Congressional deadline for FAA rulemaking. The rulemaking proposes minimum seat dimensions that accommodate 90%-92% of the population. The rulemaking proposes a minimum seat pitch of 32 inches and a minimum seat width of 20 inches, among other seat dimensions.

FlyersRights first filed a rulemaking petition in 2015 calling for a moratorium on further seat size shrinking and for the FAA to study the issues. The FAA denied the petition in 2016 by citing secret studies. After FlyersRights.org appealed the denial in federal court, the D.C. Circuit Court of Appeals ordered the FAA to provide the evidence it relied upon or to reconsider its denial. In 2018, the FAA again denied the petition. Just a few months later, Congress passed the 2018 FAA Reauthorization Act, which required the FAA to finally promulgate minimum seat size standards by October 5, 2019. FlyersRights.org filed a mandamus petition in early 2022 to attempt to have the FAA follow the law. That case is pending. The FAA has not begun the formal rulemaking process more than four years after the law was passed.

Even though Congress has instructed the FAA to to establish minimum seat sizes on airplanes, the FAA has done nothing about it citing that the instructions did not require them to do so without incurring penalties.
